Your access to and use of logsplitters.com is subject to the terms of the agreement below ("Agreement"). For inclusion into the Forestry
Products Directory and to gain access to the logsplitters.com services, read the Agreement. By agreeing to the terms and conditions of the Agreement you represent that you are 18 years of age or older, and that if you are representing a school, business, or other organization you have the authority to contract on behalf of that organization.
1. License
a.) Grant. You are granted a non-exclusive, nontransferable, limited license to access the
logsplitters.com services, which consists of various
logsplitters.com databases, services, and remotely accessed materials (collectively "Features") which may change from time to time.
Logsplitters.com may restrict access to certain Features at anytime.
LOGSPLITTERS.COM RESERVES THE RIGHT TO DENY SERVICE AND INCLUSION INTO IT'S DATA BASES TO ANY USER ANYTIME WITHOUT GIVING PRIOR NOTICE OR SUFFICIENT REASON(S).
b.) Limitations. You may not copy, download, store, publish, transmit, transfer, sell or use any part of the Data except (i) as permitted by this Agreement, (ii) without
logsplitters.com's prior written permission, or (iii) if not prohibited by this Agreement or as allowed under the Fair Use provision of the US Copyright Act. Data may not be stored in an archival or other searchable database unless permitted by this Agreement or quoted in your work product. You may not sell, license or distribute Data in any format to third parties or use Data as a part of or as a basis for any material offered for sale, license or distribution. You cannot use Data in the
logsplitters.com to create mailing or marketing lists for commercial purposes or for distribution to third parties.
c.) Rights in Data. Except for the license granted in this Agreement, all right, title and interest in Data, in all languages, formats and media throughout the world, including all copyrights, are and will continue to be the property of
logsplitters.com and other contributors ("Contributors") of Data.
d.) The Free Classified Ad Section is to be used
by private parties or individual Internet users only, who do not
want to advertise a Business. All Wholesalers, Retailers, or Manufacturers
may submit their Banner Advertisements for a monthly fee, according to the
logsplitters.com Services and Rates Schedule.
2.) Disclaimer of Warranties and Limitation of Liability.
LOGSPLITTERS.COM IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF PERFORMANCE, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OMISSIONS, COMPLETENESS, CURRENTNESS AND DELAYS.
LOGSPLITTERS.COM AND CONTRIBUTORS HAVE NO LIABILITY TO YOU FOR ANY CLAIM(S) RELATING TO THIS AGREEMENT OR ITS PERFORMANCE, REGARDLESS OF THE FORM OF ACTION, WHETHER BASED IN CONTRACT OR NEGLIGENCE. IN NO EVENT WILL
LOGSPLITTERS.COM OR CONTRIBUTORS BE LIABLE TO YOU FOR ANY CLAIM(S) RELATING TO EXEMPLARY, INCIDENTAL, INDIRECT OR SPECIAL DAMAGES, EVEN IF YOU ARE ADVISED OF THE POSSIBILITY OF ANY DAMAGES.
3.) Responsibility for Certain Matters. You are responsible for all access to the
logsplitters.com by your
information submitted, by means of your equipment, even if you did not authorize the access and use.
4.) Reservation of Rights. Logsplitters.com may modify the terms and conditions of this Agreement including, the imposition of access and usage limitations. Any modifications will be effective immediately upon notice to you.
5.) Limitation of Claims. Except for claims relating to improper use of the
logsplitters.com (Corporations Online Inc.) Data, or Information no claim, regardless of form, which in any way arises out of this Agreement or the use of or inability to use the
logsplitters.com or Data may be made, nor action based upon such claim brought, by either party more than one year after the basis for the claim becomes known to the party desiring to assert it.
6.) Term and Termination. This Agreement will become effective upon your acceptance and will continue in force for the duration of your
service agreement or the duration of logsplitters.com.
Logsplitters.com may terminate this Agreement immediately if you breach this Agreement or if any information provided by you is found to be false or fraudulent.
7.) Notices. All notices are sent to logsplitters.com and submitted via electronic mail to
info@logsplitters.com.
8.) Governing Law and Venue. The laws of the State of Nevada, USA govern this Agreement.
You consent to exclusive jurisdiction and venue of the courts of the State of Nevada.
9.) Other Provisions. This is the entire agreement between the parties with respect to your right to access and use
logsplitters.com. It supersedes all prior agreements. Neither this Agreement nor any part may be assigned, sublicensed or otherwise transferred by you without
logsplitters.com's prior written consent. If any provision of this Agreement found to be void, invalid, unenforceable or illegal, the validity and enforceability of the other provisions will not be affected. Failure to enforce any provision of this Agreement is not a waiver of the provision or of the right to enforce the provision. The headings and captions contained are inserted for convenience only and do not constitute a part of the Agreement.
10.) Export Laws. logsplitters.com
(Corporations Online Inc.), data, technology and related documentation may not be exported or re-exported in violation of the US Export Administration Act and its implementing regulations.
